ISSUES:

1. Whether the Board provided the Student with FAPE for the 2006-07 and 2007-08 school years.

2. Whether the Board offered the Student an appropriate program for the 2008-09 school year.

3. Whether the Parents shall be reimbursed for speech and language services, ABA services, Cynavox, mileage for private service providers, RDI therapy, parent training and a home program.

4. Whether the Student shall be provided with compensatory education.

SUMMARY:

The Board received this request for hearing on December 8 and a prehearing conference was held on December 15. On December 19, the Parent’s attorney submitted a clarified hearing request with the agreement of the Board’s attorney. On January 12, a notice from the Parent’s attorney was received which indicated that the parties had entered into a settlement agreement in this case. .

FINAL DECISION AND ORDER:

The matter is DISMISSED, with prejudice.
