ISSUES:

1. Whether the Student was denied FAPE during the 2006-07 and 2007-08 school year.

2. If so, whether the Student’s placement at Summit Academy for the ESY 2007 and at Grove School for the 2007-08 and 2008-09 school years are appropriate and shall be fully funded.

3. Whether the Student is entitled to compensatory education.

SUMMARY:

The Board received this request for hearing on June 4, 2008, and a prehearing conference was held on June 18. On July 10, prior to the first hearing date, the Parents’ attorney submitted notification that the case had settled.

FINAL DECISION AND ORDER:

The matter is DISMISSED, without prejudice.
