ISSUES:

1. Whether the Board failed to offer the Student a free appropriate public education [FAPE] in the least restrictive environment for the 2006-2007 and 2007-2008 school years.

2. If not, is the Student entitled to compensatory education.

3. Whether the Student shall be provided an alternative placement for the 2007-2008 school year.

SUMMARY:

The Board received this request for hearing on November 7, 2007 and a prehearing conference was convened on November 15. On January 7, 2008, at the first hearing date, the Parent’s attorney reported that the case had been settled.

FINAL DECISION AND ORDER:

The matter is DISMISSED, with prejudice.
