I. Whether the local educational agency provides the child with a free and appropriate public education in a location which is agreeable to the parent?
PROCEDURAL HISTORY
The parent requested a due process hearing. At a prehearing conference the parent requested a hearing which would provide time to recover from personal medical problems; and agreed to extend the date to mail the final decision to December 4, 2007. The parent wanted the first day of hearing to be scheduled on November 15, 2007. The parent did not appear at the hearing convened on November 15, 2007. An additional hearing date, November 20, 2007, was entered on the record. On November 20, 2007, the parent failed to appear. There has been no communication with the parent since a prehearing conference on October 16, 2007. The matter is dismissed for failing to prosecute the claims. The matter was resolved within 45 days and any applicable extensions of the date for mailing the final decisions as agreed upon by the parties.
