ISSUES:

1. Whether the Board’s proposed program for the Student for the summer 2007 and the 2007-2008 school year is appropriate.

2. If not, whether the Parents’ residential placement of the Student at Devereux Center effective July 2 is appropriate.

3. Whether the Student requires a residential placement to receive a free appropriate public education [FAPE].

SUMMARY:

The Board received this request for hearing on July 17, and a prehearing conference was held on August 2. At the first hearing date on September 14, it was reported that the Parents were attempting to have another agency participating in the placement, providing alternative funding. The case was continued to October 23, which was postponed to November 5 to allow the parties to coordinate with the other agency.

At the hearing on November 5, the Board’s attorney reported that the matter was resolved, and submitted a facsimile from the Parents’ attorney which confirmed that the parties had just reached a settlement of the matter.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
