SUMMARY
This special education hearing was requested via Request for Impartial Special Education Hearing dated July 10, 2007 and received by the Board on July 11, 2007. The 30-day resolution period ran through August 10, 2007. The original deadline for mailing the final decision and order was September 24, 2007.
On July 31, 2007, on behalf of the Student, Attorney Feinstein made a written request for an order of stay-put in the middle school that was the last agreed upon placement. The request was granted via written decision and order dated August 19, 2007.
On August 3, 2007, a telephonic pre-hearing conference was held and hearings were scheduled to begin on September 4, 2007. On August 21, 2007, Attorney Gwen J. Goodman of Shipman & Goodwin requested a postponement of the hearing in order to allow the parties to pursue resolution through mediation.
Via letter dated August 21, 2007, Attorney Feinstein requested a 30-day enlargement of the time for the final decision and order and postponement of the scheduled hearing dates in order to allow the parties to pursue resolution through mediation. The deadline for mailing the final decision and order was extended until October 24, 2007.
Via letter dated September 14, 2007, Attorney Feinstein requested an additional 30-day enlargement of the time for the final decision and order and postponement of the scheduled hearing dates in order to allow the parties to formalize a settlement agreement. The deadline for mailing the final decision and order was extended until November 23, 2007. Hearings were scheduled to begin on October 22, 2007. Prior to the hearing convening, the parties resolved the matter. Via letter dated October 18, 2007, Student withdrew the due process request with prejudice.
In light of the above facts, the above-captioned case is hereby dismissed with prejudice.
