ISSUES:
I. Whether the Board had a basis of knowledge that the Student was a child with a disability before the behavior that precipitated the pending disciplinary action occurred.
II. Whether the Student qualifies for special education.
III. Whether the behavior that resulted in the pending disciplinary action was a manifestation of the Student’s disability in that the conduct in question was caused by, or had a direct and substantial relationship to, the Student’s disability.
SUMMARY:
The Board received this request for hearing on June 26, at which time an expulsion hearing was pending. This matter proceeded as an expedited hearing. On August 1 the hearing convened, at which time the parties noted on the record that a settlement was reached on all issues.
FINAL DECISION AND ORDER:
The matter is DISMISSED, with prejudice.
