PROCEDURAL HISTORY

The Newtown Board of Education filed a due process hearing request with the State Department of Education (SDE) on June 20, 2006. This Hearing Officer was assigned to the case on June 23. A prehearing conference was scheduled for July 7. On July 6, the Board's attorney sent a letter to the Hearing Officer stating that the Parents had withdrawn their request for an independent evaluation at public expense and that she was withdrawing the hearing request as moot. The decision deadline is September 5, 2006.

It is ordered that this case be dismissed.
