PROCEDURAL HISTORY

The Parents filed a due process hearing request with the State Department of Education (SDE) on April 27, 2006. This Hearing Officer was assigned to the case on April 28. The Board received the due process request on April 27, 2006. A prehearing conference was held on May 23 at which time the parties agreed to schedule hearing dates on June 14 and July 11, 2006. The decision deadline was extended from July 11 to August 4 to accommodate the July 11 hearing date. On June 7 the Parents' attorney wrote to the Hearing Officer and stated that a tentative settlement was reached and that the Parents wished to withdraw the due process hearing without prejudice "at this time." She further stated that "as soon as the agreement is fully signed," they would withdraw with prejudice. As of June 30 no further correspondence was received from the parties. The Hearing Officer cancelled both hearing dates.

It is ordered that this case be dismissed with prejudice.
