ISSUE:
Has the Board offered an appropriate program to the student for the 2004-2005 school year?
FINDINGS OF FACT:
This hearing was requested on June 9, 2004. The prehearing conference was convened on June 15, 2004 at which time the hearing was scheduled for July 8, 12, 13, 20 and 22, 2004. On June 25, 2004, the parties requested a postponement of the hearing scheduled for July 8 in order to discuss settlement. On June 30, 2004, the parents informed the hearing officer that a settlement had been reached and asked permission to 1. Withdraw without prejudice; and to 2. Later withdraw with prejudice upon execution of the agreement. The hearing officer wrote to both parties noting that only one withdrawal was necessary. In addition, the hearing officer stated that the hearing would be dismissed with prejudice if by noon on July 9, 2004, the parties did not notify the hearing officer that the hearing was going forward on July 12, 2004. There was no further communication from the parties.
FINAL DECISION AND ORDER:
This hearing is dismissed with prejudice.
