PROCEDURAL HISTORY:

The parent requested a due process hearing. A prehearing conference was held on May 1, 2002. Hearings convened on, May 28, 2002, June 24, 25 and August 2, 2002. The parties believed they would be able to reach settlement and the parent’s attorney communicated he would request additional hearing dates if was necessary. He has not requested additional hearing dates.

FINAL DECISION AND ORDER:

The matter is dismissed with prejudice.
