ISSUES:
1. Failure to offer an appropriate program and placement for the 2001-2002 school year;
2. Failure to offer extended school year services for the summer of 2001;
3. Violation of the child-find provisions of the IDEA;
4. Failure to properly evaluate;
5. Request for reimbursement of parent’s unilateral placement at the Hope Academy in Milford, Connecticut;
6. Request for reimbursement of parent’s unilateral placement at the Kildonen School in Amenia, New York for the summer of 2001;
7. Compensatory education.
SUMMARY:
The matter was assigned on July 17, 2001. A prehearing conference was scheduled for July 20, 2001, and notice was sent via facsimile transmission to the parent’s counsel and the Board’s representative. No proper request for postponement was submitted by either party or granted by the undersigned hearing officer prior to the prehearing. Neither the parent’s counsel, nor the Board’s representative were available for the scheduled prehearing conference on July 20. A second prehearing conference was scheduled for July 25, 2001, and notice was sent via facsimile transmission to the parent’s counsel and the Board’s representative. No proper request for postponement was submitted by either party, or granted by the undersigned hearing officer. Neither the parent’s counsel, nor the Board’s representative were available for the scheduled prehearing conference on July 25.
FINAL DECISION AND ORDER:
The matter is DISMISSED, without prejudice.
