ISSUES:

1. Did the Board offer an appropriate program at the April 21, 2020 and April 16, 2021 PPT meetings?

2. If not, is Cedar School an appropriate placement?

3. If so, should the Board be required to financially support the Student’s placement at Cedar School?

PROCEDURAL HISTORY/SUMMARY:

The Parent filed the Due Process Complaint and Request for Hearing on May 1, 2021. The Hearing Officer was appointed on May 5, 2021and conducted a Prehearing Conference on May 21, 2021. The hearing was scheduled for June 17, 2021. On June 21, 2021, the parties reported that they were close to an agreement and requested a postponement of the hearing. The Parents’ request for extension of the mailing date of the Final Decision was granted. The mailing date was extended to August 17, 2021. The hearing was rescheduled to July 22, 2021. On July 15, 2021, the withdrew the Due Process Complaint with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
