ISSUES:
1. Did the Board fail to provide FAPE for the 2019-20 commencing April 28, 2019 school year, including ESY?
2. Did the Board fail to provide FAPE for the 2020-21 school year, including ESY?
3. If so, is placement in a private therapeutic setting appropriate at the Board's expense?
4. Should the Board be required to reimburse the Parent for the neuropsychological evaluation and private counseling for the Student?
5. Is compensatory education appropriate?
PROCEDURAL HISTORY/SUMMARY:
The Student is entitled to receive a free and appropriate public education in the least restrictive environment as defined in the Individuals with Disabilities Education Improvement Act (“IDEA”) §20 U. S. C. 1401 et seq. and Connecticut General Statutes §10-76a et seq. The Parents filed the Due Process Hearing Complaint on April 28, 2021. The Hearing Officer was appointed on April 28, 2021. A pre-hearing conference was held on May 18, 2021. The mailing date for the final memorandum of decision was established as July 12, 2021. Hearings were scheduled for June 16, 2021 and June 23, 2021. The Board withdrew the complaint on June 8, 2021.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
