ISSUES:

1. Does the Extended School Year (“ESY”) program offered by the District provide this Student with a Free and Appropriate Public Education (“FAPE”) for the 2020-2021 school year?

2. If not, should the District be ordered to provide a program that offers the student FAPE at Innovative Autism Services at its expense?

PROCEDURAL BACKGROUND:

The Student and his Parents filed a Request for Due Process Hearing (“Complaint”) on April 28, 2021 against the Board. The undersigned Impartial Hearing Officer was assigned the case on April 28, 2021. A Prehearing Conference was held on May 13, 2021. The parties requested and engaged in mediation. The hearing date was set for May 28, 2021, with the date for mailing the final decision of July 13, 2021. On May 20, 2021, following mediation, Counsel reported that the matter had been settled to the satisfaction of all parties and the request for due process has been withdrawn with prejudice. Accordingly, the matter is dismissed with prejudice.

FINAL DECISION AND ORDER:

The case is DISMISSED with prejudice.
