ISSUE:

1. Was the Board’s Multidisciplinary Triennial Evaluation dated May 22, 2019 appropriate and if not, is the Board required to provide an Independent Educational Evaluation (IEE) at Board expense?

PROCEDURAL BACKGROUND:

The Simsbury Board of Education filed a Request for Due Process Hearing (“Complaint”) on March 26, 2021 against the Student to address the above issue. The undersigned Impartial Hearing Officer was assigned the case on March 28, 2021. A Prehearing Conference was held on March 30, 2021. The hearing date was set for April 20, 2021, with the date for mailing the final decision of May 10, 2021. Counsel requested an extension of time to engage in mediation. The hearing date was extended to May 19, 2021, with the last date for mailing the final decision of June 9, 2021. On May 6, 2021 counsel reported that the matter had been settled to the satisfaction of all parties and the request for due process was withdrawn. Accordingly, the matter is dismissed.

FINAL DECISION AND ORDER:

The case is DISMISSED.
