ISSUES:
The following issues have been identified for determination at the hearing:
1. Is the Greenwich Board of Education’s Evaluation of the Student appropriate?
2. If not, is the Student entitled to an Independent Education Evaluation in the area of Speech and Language and/or Neuropsychology at public expense?
3. Did the Greenwich Board of Education fulfill its Child Find obligation?
4. Did the Greenwich Board of Education offer the Student a Free Appropriate Public Education in both procedure and substance?
PROCEDURAL HISTORY:
The Board of Education filed request for due process Case No. 21-0289 on March 23, 2021. The case was assigned for hearing before Hearing Officer Ann Bird. A prehearing conference was conducted on April 22, 2021. Attorney Abbey Wadler appeared on behalf of the Board of Education. Attorney Piper Paul appeared on behalf of the Student. It was determined that the initial deadline for issuing the final decision was May 7, 2021. Pursuant to Order dated April 22, 2021, the deadline was extended to June 4, 2021. It was further decided that a second prehearing conference would be conducted on May 6, 2021.
On April 6, 2021, the Student submitted request for due process Case No. 21-0301 involving many of the same issues as raised in Case No. 21-0289. Case No. 21-0301 was assigned to Hearing Officer Sylvia Ho.
A prehearing conference for both cases was conducted on May 6, 2021. During the conference, the parties and the hearing officers agreed that the two cases would be consolidated and heard by Hearing Officer Bird. It was further agreed that the deadline for issuing the final decision for Case No. 21-0301 and the consolidated cases would be reset to June 18, 2021. An Order of Consolidation and Management setting forth these agreements was issued on May 6, 2021.
On May 28, 2021, the Student and the Greenwich Board of Education requested that this consolidated matter be dismissed.
FINAL DECISION AND ORDER:
The parties’ request is granted and the matter is dismissed.
