ISSUES:
1. Whether the District’s proposed change of placement made at the March 18, 2021 PPT is appropriate?
2. Whether the Student should remain within his current IEP and placement due to his making measurable progress within the least restrictive environment?
3. If not, whether another placement that has not yet been proposed for the Student should be developed and proposed?
PROCEDURAL HISTORY/SUMMARY:
The Guardians brought their Hearing Request on March 23, 2021. The Hearing Officer was appointed that same date. A Prehearing Telephone Conference took place on April 1, 202. A hearing on the matter was subsequently scheduled for June 4, 2021. The mailing date was extended upon request until August 6, 2021, and a hearing was scheduled for July28, 2021.
On July 9, 2021, the Guardians informed the Hearing Officer that they were withdrawing their request for a Due Process Hearing with prejudice.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
