ISSUES:

1. Did the Board offer an appropriate program for the 2020-2021 and for the school years and extended school years for the two years prior to the filing of the Due Process Complaint?

2. If not, is placement at Watkinson School the appropriate program for the 2020- 2021 school year?

3. If so, should the Board be required to place Student at Watkinson School?

4. Do the circumstances warrant an award of compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Board brought the Due Process Complaint and Hearing Request dated February 10, 2020. The Hearing Officer was appointed the same day. A prehearing conference was conducted on February 25, 2021. The parties reported that they agreed to mediation and required additional time to negotiate. The parties were directed to report the date of mediation and availability for hearing. Neither party complied with the Hearing Officer’s request. The Board has brought the Hearing Request but has failed to prosecute the hearing. The matter will be dismissed pursuant to RCSA §10-76h-18.

FINAL DECISION AND ORDER:

The matter is DISMISSED
