ISSUES:

1. Did the Board offer an appropriate program for the 2020-2021 school year, including 1:1 home support?

2. Did the Board fail to consider parent input in developing the IEP?

3. Did the Board fail to conduct appropriate evaluations?

4. If any of the issues above are answered in the negative, is Pinnacle an appropriate placement for Student?

5. If Pinnacle is an appropriate placement, should the Board be required to place Student at Pinnacle School?

6. Do the circumstances warrant an award of compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parent filed the Due Process Complaint and Request for Hearing on January 11, 2021. The Hearing Officer was appointed on January 14, 2021 and conducted a Prehearing Conference on January 28, 2021. The hearing was scheduled for March 23, 2021. The Parents’ request to extend the mailing date and postpone the hearing to mediate was granted and the hearing was canceled and rescheduled to April 23, 2023. On April 1, 2021, the Parent withdrew the Due Process Complaint with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
