ISSUES:

1. Was the District’s decision to place the Student in a diagnostic evaluation placement at the Northwest Village/Wheeler Clinic appropriate?

2. If not, what is the appropriate placement for the Student?

3. Can the Student remain on remote instruction while a diagnostic placement is explored?

PROCEDURAL HISTORY/SUMMARY:

The District filed the Due Process Complaint and Request for Hearing on December 22, 2020. The Hearing Officer was appointed on December 23, 2020. Several Prehearing Conferences were scheduled on the dates of December 30, 2020, January 12, 2021 and January 26, 2021 to accommodate scheduling conflicts. The parties expressed a desire to resolve the dispute at the Prehearing Conference. Before agreeing on a hearing date, the Hearing Officer was notified by counsel for the District via email on January 25, 2021 that it was withdrawing its request for a Due Process Hearing.

This case is DISMISSED without prejudice.
