PROCEDURAL HISTORY/SUMMARY:

The Board brought the Due Process Complaint and Hearing Request dated November 23, 2020. The Hearing Officer was appointed November 30, 2020. The Hearing Officer wrote the parties and scheduled a Prehearing Conference on December 11, 2020. The parties reported that they agreed to mediation and required additional time to negotiate. The parties were directed to report the date of mediation and availability for hearing. Neither party complied with the Hearing Officer’s request. The Board has brought the Hearing Request but has failed to prosecute the hearing. The matter will be dismissed pursuant to RCSA §10-76h-18.

FINAL DECISION AND ORDER:

The matter is DISMISSED
