ISSUES:
1. Was the Student denied FAPE for the 2018-2019, 2019-2020 and 2020-2021 school years?
2. If so, are the Parents entitled to reimbursement for the tuition and related costs of Caron Foundation, Turnbridge, SUWS and/or Echo Springs during the 2019-2020 and 2020- 2021 school years?
3. Are the Parents entitled to reimbursement for the July 15, 2020 evaluation of the Student by Dr. Edwards?
4. Is the Student entitled to any other relief and/or compensatory education as deemed appropriate by the Hearing Officer?
PROCEDURAL HISTORY/SUMMARY:
The Parents filed the Due Process Complaint and Request for Hearing on November 4, 2020. The Hearing Officer was appointed on November 5, 2020. A Prehearing Conference was scheduled for November 25, 2020. Hearing dates were scheduled for January of 2021, and cancelled and rescheduled as the parties had indicated to the Hearing Officer that there was a settlement agreement. For several months, hearing dates were postponed until another Prehearing Conference was held in May to determine the status of the case. The parties set hearing dates for June and July 2021. In mid-June, the parties indicated they had settled the matter and were executing an agreement. The June hearing dates were cancelled at this time, and the July hearing dates remained. On June 29, the Hearing Officer was notified via email that the Parents were withdrawing their request for a Due Process Hearing.
This case is DISMISSED with prejudice.
