ISSUES:

The following issues have been identified for determination at the hearing:

1. Is the Board of Education’s proposed speech and language evaluation appropriate?

2. If so, should it be conducted without parent consent?

3. If not, is the Student entitled to an independent educational evaluation in the area of speech and language at public expense?

PROCEDURAL HISTORY:

The Board of Education initiated this special education due process case on October 27, 2020. This Impartial Hearing Officer was assigned to the case on October 28, 2020. A Prehearing Conference was convened on November 13, 2020. No one appeared on behalf of the Student and Attorney Abby Wadler appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is December 11, 2020. A second prehearing conference was scheduled for November 24, 2020.

On November 18, 2020, the Board of Education reported that the parties had settled the matter and requested that the matter be withdrawn or dismissed.

FINAL DECISION AND ORDER:

The Board of Education’s request is granted and the matter is dismissed.
