ISSUES:

1. Has the Board fulfilled its obligation to offer the Student a Free and Appropriate Public education by its recommendation of placement of the Student in an out-of-district private school ?

2. What is the extent of the obligation of the Parents to engage in the intake process in furtherance of the implementation of the Board's recommendation?

PROCEDURAL BACKGROUND:

The Student filed this Request for a Due Process Hearing on September 21, 2020. The Hearing Officer was assigned on September 28, 2020. A Prehearing Conference was scheduled for October 9, 2020 which did not proceed and was in the process of being rescheduled. In the interim, counsel engaged in informal settlement discussions, which resulted in an agreement. The Student's Parent thereafter notified the Hearing Officer on October 19, 2020 that a settlement had been reached and the Request was withdrawn without prejudice.

FINAL DECISION AND ORDER:

The case is DISMISSED without prejudice.
