ISSUES:

The following issues were identified for determination at the hearing:

1. Is the Board of Education’s evaluation appropriate?

2. If not, is the Student entitled to an Independent Educational Evaluation in the area of speech and language?

PROCEDURAL HISTORY:

The Board of Education initiated this special education due process case on June 22, 2020. This Impartial Hearing Officer was assigned to the case on July 8, 2020. A Prehearing Conference was convened on July 15, 2020. The Student’s parent appeared on behalf of the Student and Attorney Craig Meuser appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is August 6, 2020.

The Student reported that the Student no longer requests an independent evaluation at this time. As a consequence of the Student’s report, the Board of Education requested that this matter be dismissed without prejudice.

FINAL DECISION AND ORDER:

The Board of Education’s request is granted and the matter is dismissed without prejudice.
