ISSUES:

1. Did the Board improperly exit Student from Special Education in 2015?

2. Did the Board fail to identify Student as being eligible for Special Education and Related Services in 2016, 2018 and 2019?

3. Did the Board fail to evaluate Student in all areas of suspected disability?

4. Did the Board impede the Parent’s right to meaningful participation and/or commit other procedural violations, and if so, was the Student denied a free and appropriate education as a result of such denial(s)?

PROCEDURAL HISTORY/SUMMARY:

The Legal Guardian filed the Due Process Complaint and Request for Hearing on June 29, 2020. The Hearing Officer was appointed on June 30, 2020 and conducted a Prehearing Conference on July 17, 2020. The parties reported that they had come to a resolution and were awaiting the results of a diagnostic placement to begin at the beginning of the school year. On September 8, 2020, the parties asked for an extension of the mailing date of the Final Decision due to the uncertainties of COVID and its effect on school days and the trial placement. The extension request was granted. The mailing date was extended to December 11, 2020. The hearing was scheduled for October 30, 2020. On October 28, 2020, the Legal Guardian withdrew the Due Process Complaint with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED with prejudice.
