ISSUES:

The following issues have been identified for determination at the hearing:

1. Did the Board of Education offer the Student a Free Appropriate Public Education for the 2020/2021 School Year?

2. If the Board of Education did not offer the Student a Free Appropriate Public Education for 2020/2021 School Year, is the Parent's unilateral placement at the North Country School in Lake Placid, NY appropriate?

3. If the Parent's unilateral placement at the North Country School for the 2020/2021 School Year is appropriate, does the student require a residential placement?

4. If the Parent's unilateral placement at the North Country School is appropriate should the Parent be reimbursed for the expense of her unilateral placement there?

5. If the Parent’s unilateral placement at the North Country School is appropriate should the Parent be reimbursed for the residential expenses of her unilateral placement there?

PROCEDURAL HISTORY:

The Student initiated this special education due process case on June 12, 2020. This Impartial Hearing Officer was assigned to the case on June 18, 2020. A Prehearing Conference was convened on July 1, 2020. Attorney Jillian Griswold appeared on behalf of the Student and Attorney Alyce Alfano appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case was August 26, 2020. An evidentiary hearing was scheduled for September 2, 2020.

On August 25, 2020, the Student reported that the parties had resolved the matter and requested that it be withdrawn or dismissed with prejudice.

FINAL DECISION AND ORDER:

The Student’s request is granted and the matter is dismissed with prejudice.
