ISSUE:
Are the Occupational Therapy and Physical Therapy evaluations appropriate and if not, is the Board required to provide an Independent Educational Evaluation in the areas of Occupational Therapy and Physical Therapy?
PROCEDURAL HISTORY/SUMMARY:
The Student is entitled to receive a free and appropriate public education in the least restrictive environment as defined in the Individuals with Disabilities Education Improvement Act (“IDEA”) §20 U. S. C. 1401 et seq. and Connecticut General Statutes §10-76a et seq. The Board initiated this special education due process case on May 13, 2020. The Hearing Officer was appointed on May 13, 2020. Pre-hearing conference was held on June 1, 2020. Hearing was scheduled for July 30, 2020. The original mailing date deadline for the final memorandum of decision was July 30, 2020. Subsequently, the parties requested that the hearings in this matter be continued given the Governor’s Executive Order 7-M and circumstances related to COVID-19. The mailing date of the final memorandum of decision was extended to September 30, 2020. On August 12, 2020, the Student withdrew the request for due process.
FINAL DECISION AND ORDER:
The matter is DISMISSED
