ISSUES:

1. Was the Birth to Three evaluation of the Student, which the Board accepted, appropriate?

2. If not, are the Parents entitled to an independent educational evaluation (IEE) at public expense?

PROCEDURAL HISTORY/SUMMARY:

The Board filed its Due Process Complaint and Request for Hearing on February 19, 2020. The Hearing Officer was appointed on February 19, 2020. A Prehearing Conference was noticed for and held on February 28, 2020. On May 11, 2020, via email, the Attorney for the Board notified the Hearing Officer that the parties had successfully resolved the matter and withdrew its request for a Due Process Hearing.

FINAL DECISION AND ORDER:

In light of the above, the matter is DISMISSED.
