ISSUES:

1) Did the 2019-20 IEP proposed by the Board deny the Student FAPE?

2) Is the Winston Preparatory School an appropriate placement for Student and if so, are the parents entitled to reimbursement for all costs of Student's attendance, including tuition and transportation?

PROCEDURAL BACKGROUND:

The Student filed this Request for a Due Process Hearing on February 3, 2019. The Hearing Officer was assigned on February 4, 2019. A Prehearing Conference was held on February 13, 2020, and hearing date was set for March 25 and 26, 2020 with a date for mailing the final decision of April 19, 2020. A second Prehearing Conference was held and a short extension of time was requested to reset the hearing date to April 27, 2020 and decision mailing date to May 22, 2020. On April 13, 2020, Counsel for the Student sent notice that the matter had been settled and the request for due process has been withdrawn with prejudice. Accordingly, the matter is dismissed with prejudice.

FINAL DECISION AND ORDER:

The case is DISMISSED with prejudice.
