ISSUES:
1. Did the District provide the Student with an adequate IEP?
2. If not, should the Student be placed in a specialized school such as Ben Bronz Academy?
3. Whether the psycho-educational evaluations administered to the Student by the predecessor school district were appropriate?
4. Whether the speech-language evaluations administered to the Student by the predecessor school district were appropriate?
5. Whether the social behavioral assessments administered by the Board of Education were appropriate?
6. Whether the Parent is entitled to publicly funded evaluations?
PROCEDURAL HISTORY/SUMMARY:
The Parent brought the initial Due Process Complaint and Hearing Request on January 30, 2020. The Hearing Officer was appointed on February 4, 2020.
On February 7, 2020, the Board requested a Due Process Hearing pursuant to CGS 10- 76h(a)(2) and Connecticut Agency regulations 10-76h-3(a), and requested that its petition be consolidated with the Parent’s Due Process Complaint.
The matters were consolidated on February 18, 2020. A Prehearing Telephone Conference took place on the consolidated matters on February 18, 2020, and a hearing was scheduled for April 2, 2020. In light of the COVID-19 emergency, the mailing date was extended, (on March 23, 2020), by agreement of the parties to May 14, 2020; and again by agreement, (on April 27, 2020), to June 13, 2020.
A hearing was scheduled for June 1, 2020.
On May 21, 2020, the Parent notified the Hearing Officer that the parties had reached an agreement following mediation and withdrew his request for a due process hearing.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
