ISSUES:

1. Did the Board fail to provide and/or offer FAPE to the Student for the 2017-18 - beginning January 23, 2018, 2018-19 and 2019-2020 school years?

2. Was the Pacific Quest, therapeutic wilderness program the appropriate program for the Student? If so, should the Board be required to reimburse the Parents for the cost of Pacific Quest, including related expenses and costs?

3. Is La Europa Academy the appropriate program for the Student? If so, should the Board be required to reimburse the Parents for the cost of La Europa Academy, including related expenses and costs?

4. If the Board failed to provide and/or offer FAPE, should it be required to reimburse the Parents for the cost of private counseling and academic tutoring which occurred within the last two years?

5. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY:

The Hearing Request was brought by the Student, on January 23, 2020, against the Fairfield Board of Education. A Pre-Hearing conference was held on February 5, 2020, wherein a Hearing were scheduled for March 23, 2020. On March 16, 2020 the parties reported a settlement and the Parent withdrew the Request for Due Process with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
