ISSUES:
1. Did the Board follow the proper procedures in determining whether Student was eligible for special education on or about October 22, 2019?
2. Was the denial of eligibility in #1 above based on inadequate information?
3. If The Board failed to follow proper procedures, and Student is subsequently found eligible for special education services, did the Board deny Student a Free and Appropriate Public Education (”FAPE”)?
4. Should Student be provided with current and compensatory Tier II reading interventions and re-evaluated as to eligibility once sufficient data has been collected?
PROCEDURAL BACKGROUND:
The Student filed this Request for a Due Process Hearing on December 11, 2019. The Hearing Officer was assigned on December 18, 2019. A Prehearing Conference was scheduled and held on January 7, 2020. A hearing date of January 28, 2020 was set and the date for mailing the final decision was determined to be February 24, 2020. The parties' counsel expressed their intention to engage in a resolution conference and mediation. The Student's attorney notified the Hearing Officer on January 21, 2020 that a settlement had been reached and this case was withdrawn without prejudice.
FINAL DECISION AND ORDER:
The case is DISMISSED without prejudice.
