ISSUES:
1. Are the Board's initial Educational and Psychological Evaluations appropriate?
2. If not, are the Parents entitled to an Independent Education Evaluation (“IEE”) in those areas?
PROCEDURAL BACKGROUND:
The Board filed this Request for a Due Process Hearing on November 25, 2019. The Hearing Officer was assigned on November 27, 2019. A Prehearing Conference was scheduled for December 3, 2019, but was not held. On November 27, 2019, the Parents gave notice that they were deferring their request for an Independent Education Evaluation until after a PPT conference scheduled in January. The Board's attorney then notified the parties and the Hearing Officer on December 2, 2019, that in light of the Parents' decision not to proceed with their request at this time, that the Board withdraws this case without prejudice.
FINAL DECISION AND ORDER:
The case is DISMISSED without prejudice.
