ISSUES:

1. Did the Board offer an appropriate program for the 2018-19, and the 2019-20 school years including the 2018 and 2019 extended school year?

2. If not, is placement at the Windward School the appropriate program for the Student for the 2019-20 school year, and should the Board be ordered to place the Student at the Rectory School for the 2019-20 school year?

3. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parents brought the initial Due Process Complaint and Hearing Request on November 20, 2019. The Hearing Officer was appointed on the same date. A Prehearing Telephone Conference took place on December 2, 2020.

A hearing was scheduled for January 10, 2020. On January 7, 2020, the mailing date was extended to March 4, 2020, and the hearing was continued until February 10, 2020.

On February 7, 2020, the hearing was cancelled.

On March 3, 2020, the Parents’ attorney notified the Hearing Officer that the Parents were withdrawing their request for a hearing without prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED
