ISSUES:
The following issues have been identified for determination at the hearing:
1. Is the Board of Education’s evaluation of the Student appropriate?
2. If not, is the Board of Education obligated to fund an Independent Educational Evaluation by a neuropsychologist?
PROCEDURAL HISTORY:
The Board of Education initiated this special education due process case on November 13, 2019. This Impartial Hearing Officer was assigned to the case on November 13, 2019. A Prehearing Conference was noticed for December 9, 2019 but cancelled due to counsel’s sudden illness. Subsequently, a Prehearing Conference was convened on January 7, 2020. The Student’s parent appeared on behalf of the Student and Attorney Linda Yoder appeared on behalf of the Board of Education. It was established that the initial deadline for filing the final decision in this case was December 27, 2019. The parties requested that the deadline be extended to January 24, 2020 and their request was granted. An evidentiary hearing was scheduled for February 18, 2020.
On January 20, 2020, the Board of Education requested a postponement and extension of the timelines to conduct the hearing and to file the final decision in this case to February 21, 2020. The Student did not object to the requested postponement and it was granted.
On February 3, 2020, the Board of Education reported that the parties resolved the dispute in mediation and requested that the matter be dismissed.
FINAL DECISION AND ORDER:
The Board of Education’s request is granted and the matter is dismissed.
