ISSUES:
1. Should the Student be found eligible for special education under the ADHD classification?
2. Did the Board offer an appropriate program for the 2017-18, 2018-19, 2019-20 school years including the 2018 and 2019 extended school years?
3. If not, is placement at the Rectory School the appropriate program for the Student for the 2019-20 school year and should the Board be ordered to place the Student at the Rectory School for the 2019-20 school year?
4. Is the Student entitled to compensatory education?
PROCEDURAL HISTORY/SUMMARY:
The Parents brought the initial Due Process Complaint and Hearing Request on November 13, 2019. The Hearing Officer was appointed on the same date. A Prehearing Telephone Conference took place on November 25, 2020.
A hearing was originally scheduled for January 23, 2020. The mailing date was extended until February 26, 2020. The mailing date was extended again to March 27, 2020.
A hearing was scheduled for March 4, 2020. On February 26, 2020, the Parents’ attorney notified the Hearing Officer that the parties had settled the matter and that the Parents were withdrawing their request for a hearing with prejudice.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
