ISSUES:
1. Did the Board fail to provide FAPE for the 2017-18 commencing November 7, 2017, 2018-19, school years?
2. If so, should the Parents be reimbursed for the cost of private evaluations, physical therapy during the 2016-17 school year, the July 2019 residential treatment at Evolve and the cost of the treatment at Silver Hill?
3. Did the Board fail to provide/offer FAPE for the 2016-17, 2017-18, 2018-19, school years?
4. Did the Board fail to offer FAPE for the2019-20 school year?
5. Does the Spire School constitute an appropriate educational and therapeutic placement for the Student? If so, should the Board reimburse the Parents for the cost of the Spire School and all related expenses?
6. Is the Student entitled to compensatory education?
PROCEDURAL HISTORY/SUMMARY:
The Student is entitled to receive a free and appropriate public education in the least restrictive environment as defined in the Individuals with Disabilities Education Improvement Act (“IDEA”) §20 U. S. C. 1401 et seq. and Connecticut General Statutes §10-76a et seq. The Parents filed the Due Process Hearing Complaint on November 7, 2019. The Hearing Officer was appointed on November 7, 2019. The pre-hearing conference was held on October 21, 2019. The mailing date for the final memorandum of decision was established as January 21, 2020. The Hearing dates were scheduled for January 6, 2020 and January 8, 2020. The Parents withdrew their complaint with prejudice on December 3, 2019.
FINAL DECISION AND ORDER:
The matter is DISMISSED
