ISSUES:

1. Did the Board deny procedural Due Process by developing an IEP without input from the Parents?

2. Did the Board offer an appropriate program for the 2018-2019, and 2019-2020 school years?

3. If not, is residential placement at Soundview Preparatory School the appropriate program for the Student for the 2019-2020 school year and should the Board be ordered to place the Student residentially at Chamberlain School for the 2019-2020 school year?

4. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parents brought their Hearing Request on September 10, 2019. The Hearing Officer was appointed September 11, 2019. A Prehearing Telephone Conference took place on September 16, 2019. A hearing on the matter was subsequently scheduled for November 14, 2019.

On November 1, 2019, the Parents informed the Hearing Officer that they were withdrawing their request for a Due Process Hearing with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
