ISSUES:

1. Did the Board offer an appropriate program for the 2019-2020 school year including the 2019 extended school years?

2. Is placement at Maloney Magnet School the appropriate program for the Student for the 2019- 20 school year and should the Board be ordered to place the Student at Maloney Magnet School for the 2019-20 school year?

3. Is the Student entitled to compensatory education?

PROCEDURAL HISTORY/SUMMARY:

The Parents filed their Due Process Complaint and Request for Hearing on August 25, 2019. The Hearing Officer was appointed on August 28, 2019. A Prehearing Conference was noticed for and held on September 19, 2019. The Parties had difficultly scheduling a mediation before the mailing date was to expire. Due to this difficulty, on October 18, 2019, via email, the Complaint was withdrawn by the Parents without prejudice.

FINAL DECISION AND ORDER:

In light of the above, the matter is DISMISSED.
