ISSUES:
The issues in dispute were:
(a) whether the District failed to provide the Student with a Free and Appropriate Public Education (“FAPE”) during the 2018-2019 school year;
(b) whether the District failed to offer the Student an Individualized Education Program providing for a FAPE for the 2019-2020 school year;
(c) whether the Student is receiving an appropriate educational program at the Forman School in the 2019-2020 school year;
(d) whether the District should be ordered to reimburse the parent for her tuition, transportation and related educational expenses resulting from the Student's unilateral placement at the Forman School for the 2019-2020 school year and extended school year; and
(e) whether the District should be ordered to provide the Student with a period of compensatory education to remedy the lack of a FAPE during the 2018-2019 school year.
PROCEDURAL BACKGROUND:
Counsel for the Student filed this Request for a Due Process Hearing on August 2, 2019. The Hearing Officer was assigned on August 5, 2019. A Prehearing Conference was scheduled, and held on August 12, 2019. Hearings were scheduled for September 17 and 20, 2019, with a date for mailing the final decision of October 16, 2019. On September 3, 2019, counsel for the Student notified the Board's counsel and the Hearing Officer that he was withdrawing the case without prejudice.
FINAL DECISION AND ORDER:
The case is DISMISSED without prejudice.
