ISSUES:

1. Did the Board violate procedural due process by not making a timely evaluation of the Student, and by not offering a timely IEP?

2. If so, did the board deny the Student FAPE?

3. Is the Student entitled to compensatory education, to include reimbursement for private evaluations of the Student?

4. Does the IEP developed for the 2018-19 and the 2019-20 school years provide the Student FAPE?

5. If not, are the Parents entitled to reimbursement for Forman School for the 2018-19 and 2019-20 school years?

PROCEDURAL HISTORY/SUMMARY:

The Parents brought the initial Due Process Complaint and Hearing Request on July 16, 2019, and the Hearing Officer was appointed on that same day. A Prehearing Telephone Conference took place on July 22, 2019. Hearings were scheduled for September 12th and 13th, 2019.

On August 23, 2019, the Parents’ attorney notified the Hearing Officer that the parties had settled the matter and that the Parents were withdrawing their request for hearing with prejudice.

FINAL DECISION AND ORDER:

The matter is DISMISSED
