ISSUES:

1. Is the Board’s recommendation for out of district placement pursuant to the May 28, 2019 appropriate?

2. Is an independent neuropsychological assessment of the Student appropriate?

3. Is a functional behavioral assessment of the Student appropriate?

PROCEDURAL HISTORY/SUMMARY:

The Parents filed the Due Process Hearing Complaint on June 5, 2019. The Hearing Officer was appointed on June 5, 2019. A Pre-Hearing conference was scheduled for June 12, 2019. Hearing dates were scheduled for August 13, 2019 and August 14, 2019. The mailing date for the Final Memorandum was established as August 19, 2019. Upon Motion by the Board and consent of the Parent, a thirty day extension was granted. The new Hearing Date was scheduled for September 13, 2019 and the mailing date for the Final Memorandum was extended to September 19, 2019. The Parent withdrew the Complaint on August 28, 2019.

FINAL DECISION AND ORDER:

The matter is DISMISSED.
