ISSUES:

1. Is the Board obligated to provide a means of transportation to the Student to enable him to attend school ?

2. Is the Board failing to provide a Free and Appropriate Public Education to Student by failing to provide transportation for him ?

PROCEDURAL BACKGROUND:

Counsel for the Parent filed this Request for a Due Process Hearing on May 15, 2019. The Hearing Officer was assigned on May 16, 2019. A Prehearing Conference was held on May 21, 2019. A hearing was scheduled for June 18, 2019, with a date for mailing of the final decision set for July 18, 2019. On June 13, 2019, Counsel for the Parent withdrew the case without prejudice.

FINAL DECISION AND ORDER:

The case is DISMISSED without prejudice.
