ISSUE:
Whether the Board may perform a risk assessment evaluation over the objection of the Student’s guardian?
PROCEDURAL HISTORY/SUMMARY:
The Board filed the Due Process Complaint and Request for Hearing on March 26, 2019 (Case #19-0447). The Hearing Officer was appointed on March 29, 2019. The Parent filed a Due Process Complaint (Case #19-0448) on March 27, 2019, which was assigned to Hearing Officer Raymond Rigat. A Prehearing Conference was held on April 10, 2019 on Case #19-0447. At that time, the Parties reported that the Parent’s Complaint was before Hearing Officer Rigat and they intended to move to consolidate the matters. The Parent filed a request to transfer Case #19-0448 to this Hearing Officer, which motion was granted by Hearing Officer Rigat on April 23, 2019. On May 13, 2019, via email, the Parent’s Complaint was reported as settled and withdrawn. On May 14, 2019, the Board likewise withdrew its Complaint.
FINAL DECISION AND ORDER:
In light of the above, the consolidated matter is DISMISSED.
