ISSUES:
1. Was the School's transitional evaluation of the Student appropriate?
2. If not, are the Parents entitled to an Independent Educational Evaluation (“IEE”) in the areas of transitional evaluation, at the School's expense?
PROCEDURAL BACKGROUND:
The Board filed this Request for a Due Process Hearing on March 22, 2019. The Hearing Officer was assigned on March 22, 2019. A Prehearing Conference was scheduled and held on March 28, 2019. At the conference, a hearing date of April 24, 2019 was established, and the mailing date for the final decision of May 17, 2019. On April 19, 2019, counsel reported that the matter was settled and counsel for the Board withdrew the request for due process. Accordingly, the matter is dismissed without prejudice.
FINAL DECISION AND ORDER:
The case is DISMISSED without prejudice.
