ISSUES:
1. Did the Board fail to promptly identify and evaluate the Student as eligible for Special Education prior to January 2018?
2. Is the individualized education program (IEP) most recently proposed by the Board during the Student's annual review on January 17, 2019, included ESY, reasonably calculated to provide the Student with a free appropriate public education in the least restrictive environment?
3. If not, does the Student require a private placement?
4. If so, is Easton Country Day School or any other therapeutic day school proposed by the Parent appropriate?
5. If Easton Country Day School or any other therapeutic day school proposed by the Parent is appropriate, should the Board be required to financially support the Student’s placement at Easton Country Day School, including the expense of supportive services?
6. If the Student should return to his home school, what are the appropriate Special Education supports and services he requires?
7. Under the IDEA, should the Board be required to fund an Independent Educational Evaluation for this Student in the area of Physical Therapy?
8. Is compensatory education an appropriate remedy?
PROCEDURAL HISTORY/SUMMARY:
The Parents filed the Due Process Hearing Complaint on March 11, 2018. The Hearing Officer was appointed on March 11, 2019. At the pre-hearing conference was held on March 21, 2019. Parents filed an amended complaint on April 3, 2019. A second Pre Hearing conference was held on April 17, 2019 and the date for the mailing of the final memorandum of decision was set for June 17, 2019. Upon Motion by the parties, the date for the mailing of the final memorandum of decision was extended to July 17, 2019. Hearing in this matter was scheduled for July 16, 2019. The Parents withdrew their complaint on July 16, 2019.
FINAL DECISION AND ORDER:
The matter is DISMISSED.
