ISSUES:
1. Is the Board of Education’s reevaluation consisting of a psychoeducational evaluation, speech and language evaluation and academic achievement evaluation sufficiently comprehensive and appropriate?
2. If not, are the Student’s Parents entitled to an Independent Education Evaluation in the area of a comprehensive transition assessment that includes a functional vocational evaluation at public expense?
PROCEDURAL HISTORY:
The Board of Education initiated this special education due process case on March 4, 2019. This Impartial Hearing Officer was assigned to the case on March 6, 2019. A Prehearing Conference was convened on March 22, 2019. The Student’s parents appeared on behalf of the Student and Attorney Christine Sullivan appeared on behalf of the Board of Education. It was established that the deadline for filing the final decision in this case is April 15, 2019. An evidentiary hearing was scheduled for May 2, 2019.
On March 24, 2019 the Hearing Officer issued an Order Extending Deadline at the request of the Board, extending the deadline for filing the final decision in the case to May 15, 2019.
On April 23, 2019, the Board of Education reported that the Parents withdrew the request for an Independent Educational Evaluation pursuant to a settlement agreement, and therefore requested that this matter be withdrawn or dismissed.
FINAL DECISION AND ORDER:
The Board of Education’s request for dismissal is granted and the matter is dismissed.
