ISSUES:
1. Did the District fail to offer the Student a program that provided him with FAPE for the 2018-19 school year?
2. If so, is the program provided at the Fusion Academy an appropriate one for the Student?
3. If the answers to the foregoing are in the affirmative, should the District be ordered to reimburse the Parents for tuition, transportation and related educational expenses for the Student’s placement at the Fusion Academy for the 2018-19 school year?
SUMMARY AND PROCEDURAL HISTORY:
Case 19-0376 was commenced by the Parents by request received by the Board on February 19, 2019. A prehearing conference was held on February 26, 2019. At the prehearing conference, hearing dates were set for April 2, 2019 and April 3, 2019 and the decision date was determined to be May 3, 2019. The hearing dates were later cancelled.
On March 27, 2019, the undersigned hearing officer was advised by the attorney for the Parents that the parties had reached a settlement in the case and the matter should therefore be dismissed with prejudice.
FINAL DECISION AND ORDER:
The matter is dismissed with prejudice.
